I am working with a big company (company A) as a full time employee. My GC was filed under EB3. Priority Date is June 2004. Through another consulting company(company B), we started another GC process under EB2. Its priority date is March 2005. Based on what I read on various forums, it is possible to do interfiling from EB3 to EB2 and port priority date from EB3 to EB2. Is it true? We did not recapture the priority date when 140 for EB2 was filed. 140 for EB2 was approved under March 2005 priority date. I have EAD from employer A. Can I join employer B using that EAD and interfile from EB3 to EB2? Or is H1 transfer a safer option?
Appreciate your suggestions and thoughts on this.

My I485 application was received at the Texas center on Nov 6th. No receipts yet and checks have not cashed, although the USCIS website says it is current for receipts. Anyone in my situation?

I have I-140 approved from my old employer. My new employer is starting my PERM. We plan to port my old priority date. My question is at what stage of GC process from new emplyer can the old priority date be proted - PERM, I-140 or I485?

My EB3 I140 got approved in June2008. I am planning to convert EB3 to EB2 and preparing to apply labor through EB2. If EB2 labor got denied, is my EB3 I140 still valid? Do i get a RFE if apply for I485 using EB3 I140? Any Lawyers please..

Folks,
My wife got terminated on Feb 13th, she received her last pay stub on Feb 20th...We haven't applied for a COS till date...Is she now out of Status..??? She was waiting on her last paystub before she can apply for a COS and she received around 24th of last month and now we are all ready to send our documentation for COS to USCIS. During this span of 2 weeks is she considered staying illegal here..??
I was reading somewhere if USCIS receives her COS after her employer h1b revocation, she might be denied her COS...Is this true...??? Please Advise.
I was also reading somewhere about e-filing for COS, is e-filing available for H1 to H4 COS..??

I have heard it is possible to change employer on 7th year of H1-B, though not immediately. The new employer should file LCA more than 365 days before the H1-B expires. Next time when renewing H1-B it can be renewed with new employer.

Please verify the above thoroughly before taking any step.

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.

I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

I am one of the July 2007 EAD filers and did not file for AP at that time.

So I am in the process of the renewing EAD & Applying for AP for the first time.

I have couple of questions..

do you get Finger Printing for EAD Renewal ?

do you get Finger Printing / Biometrics for first time applying of AP [Advance Parole]
