Hello :
My EAD is valid till August 10, 2010. This is my second EAD. 1st filed with I-485 in 2007 and second renewed in 2008.
First Renewal Attempt :
I therefore sent my papers to my employer in early April 2010 (120 days in advance). My employer to 10 days to file with USCIS (Snail Mail - Phoenix Lockbox). Then USCIS took another 30 days to look at my papers. They rejected it. Reason :
The check amount is incorrect, or has not been provided. Please review the Form Instructions for fee information. Please resubmit the application/petition package with the appropriate fees to the USCIS address listed on the bottom of this notice.
The eligibility code you provide on your I-765 requires proof that an I-485 has been submitted. Please resubmit your Form I-765 with a copy of your Form I-485 receipt notice (I-797).
Turns out my employer did provide checks were provided in the correct amount but the name on the check was incorrect "USCIS Vermont Office"...Go figure.
Further, I had never received my I-485 receipt notice in mail (filed when the flood gates opened in July/August 2007). I had however received my ASC FP notice and had used it in my previous EAD renewal in 2008. I had sent in a copy of this with my paperwork. That did not seem to have worked. So I called USCIS NSC and they informed me that I need to attach a cover letter with my application explaining that I did not receive the I-797 for the I-485.

So this time, I filed my application to the Phoenix Lockbox myself via snail mail (never efiled so thought why take a chance). I sent my own checks payable to "US Department Of Homeland Security" as mentioned in the I-765 instructions. I also included a cover letter about my missing I-485 receipt notice and sent in the I-485 ASC FP notice copy along with a printout of the pending I-485 from USCIS website.
This new app reached USCIS on June 1, 2010.
It got rejected again and reached me yesterday on June 19, 2010. Reasons...Exactly the same as before.
Needless to say, I was confused, frustrated, angry, sad...and everything in between.

Given that only 50 days are left for my current EAD to expire. I e-Filed again yesterday (June 20 2010) hoping that by doing so, I will bypass the Phoenix Lockbox and will avoid the reason for rejection regarding the check.
I will be mailing my supporting documents tomorrow. They will reach USCIS on June 22 2010. The only thing/s addtional that I am sending in now are...
a) The top tear-off from the original EAD mailer (had forgotten to send it in last two times as I thought it was not necessary)
b) A request for correction on the eFiled EAD as I mentioned "Country Of Citizenship" as "USA" instead of "India" (Thanks to my frustrated mood and the poor usability of the I-765 online form).
Request advice...
I know that I will have to stop working on August 11 2010 and I can't earn for as long as I don't have a valid EAD in my hand. I also know that it does not affect my Green Card I-485 app as long as I don't work without and EAD.
So what should I do from here on? Should I wait...I still have 50 days to hope to get my renewed EAD in. Should I call USCIS and request expedited processing of my case...but I haven't even received my receipt notices yet. Should I book and INFOPASS appt...but INFOPASS appointments for I-765 are only issued if it has been more than 90 days since the application was filed?
I will really appreciate any comments/suggestion regarding my case.

My lawyer sent a letter of interfiling to NSC but I do not think that they have taken any action on that. I have never seen any LUD on my pending 485. However, your case is stronger than me as your PDs based on sub labor is current so if you can aggresively try interfiling , you will succeed. Is your older PD I-140 approved ?

Are you now on the 'undocumented immigration' thing ? Undocumented is someone who had documents, but lost them. Called them using the correct designation; illegal aliens.

Dear Friends,
I have an approved I-140 with PD of Mar 06, but i left this company to join a new company. I have tried many times to file PERM through this new company but still unsuccessful. I am waiting to withdraw my PERM appeal to file a new PERM since January 09 (so folks don't ask me to update my profile because i am yet to file PERM, I have updated my profile three times since 2006 and also cleared it).
Question: When i spoke to my company's lawyer regarding my earlier I-140 they say that first i need to get my PERM approval (I agree) and than i need to get my I-140 approval (Which i am not sure) inorder to port priority date, is it true? Can't we port Priority date along with I-140 application itself?

Short answer No. Long answer: it depends on when you will apply for 485. For example: you filed I-140 on Jan 1-st 2006, it was approved on Jan 1-st 2007, so it was pending for 365 days. You are applying for 485 when you child is 21 years and 364 days old - he is covered by CPA (Child protection act) and can file 485 as your dependent. One day later - he is not covered and could not file 485.

One must consider this before deciding on premium processing. I took the PP route and got I140 approval in 118 days. Dont know if I will have the opportunity to file I485 before my child turns 21 + 117 days.

I just read the summary prepared by IV core team -a job well done.
I like to think that being illegal is better than legal as per the provisions in CIR!
What do you think of H4-spouses who can't work whereas those illegal can now apply for a work-visas!
What do you think of parents who were not issued visitor visas for silly reasons? Whereas those who by hook or crook got here are being given work-visas?
How come the illegals are guaranteed a GC within 5 years and the current legal immigrants are NOT?
How come the illegals can work and the legal residents on certain visas can't?
How come the illegals can work for any employer while H1Bs can't?
I am not against giving these benefits to illegals if that's how it needs to fixed. But what about us, the bright and good folks!!

Send school the copy of EAD and I-485 for her and that should be it. After that, they can report to whoever they want (ofcourse they won't because there is nothing to report since your wife can continue with the school on EAD without registering for cradit hours)
I need urgent advice from you. As you know my wife is on F1 visa and completed most of her credit hours needed by school. She has get only 1 credit hr to complete the course. However, that�s below 9 hr full time student status. She has been asked to register for additional 8 hrs..and pay tuition fee accordingly ( > 8K). Which I think is unreasonable. They told her that if she doesn�t register by tomorrow they have to report it to INS. She told them that she has EAD..there answer doesn�t matter in order to remain in school and F1 visa she has to register.

1) Can she continue working on her Thesis on her EAD and AP ?
2) What will happen to her f1 if she use EAD

Great thread! By the way, you can't join the illegal queue anymore since you had to be illegal by the beginning of this year, and longer you have been illegal the better! Haha! So with your less than 1 year illegal status, you'd probably be still left at the end of the queue along with the legals. And if you've only been without status for a few days, you're probably screwed the worst!
This law is a testament to how poorly the Congress understands what they are doing. Instead of fixing the broken law, which needs to be cleaned up, simplified GREATLY, streamlined and made consistent with both itself and other laws, they're just adding more of the same on the top. This will make the law even more complex and even more people will fall in between the cracks in the future.
This proposal needs to be trashed completely, forget the small measures of raising the caps, etc... You're only putting a bandaid on a gun shot wound. They seriously need to go back to the drawing board and REFORM the ORIGINAL law.

If the bills don't pass before the end of this fiscal year, then we are stuck for one more year (wishing and hoping) before any provisions pass and take effect in Oct 2009. Even if there are any provisions that take effect in Oct 2009, we have to consider the delays due to USCIS backlogs (imagine what CIR will do) and adjudication time. There is really no fun in this lifestyle of uncertainty. This is our chance to make it happen for us. Let each one of us play a key role in deciding our own future. Let's do it.

Its law the day when it is signed by the president unless there is clause in the bill to postpone the impelmentation.
I guess it becomes law on or before 2/15, as Pres must sign these bills in to law on or before 2/15. Not sure when we can file for 485. :(

Its weird but found out the reason for LUD change. I had done address change in June 1st week. But didn't get any notice from USCIS. All the hard LUD and wrong message of case transfer was due to the confirmations we got in mail about the address change.
But intrestingly got soft lud on mine and husband's 485 today morning. Don't know what is happening. We have applied for my husband's EAD renewal . But his EAD application had already soft LUD after Finger printing. These LUDS are after almost a week and on 485.
