I got my pp renewed at NY 3 months ago. i took regular passport size photos from local walmart. no special requirements. Also, if you are going in person, there is a instant photo booth in PP office, there you can take your passport photos. dont count on it though, some times its out of order.

The point is that to lobby for keeping the spouse out of the "VISA NUMBERS CURRENT" constrain may not be politically hot as it becomes a very compulsive and humanitarian issue. There is expected to be less resistance and public support as its a family issue. Success may be relatively easy and hence its a ponderable issue.

Take your emails, faxes and letters one step further now. Pls try to set up appointments with lawmakers of your state. Get active in your state chapter. If it is inactive, activate it yourself. If you dont have anybody to help you, then do it yourself and meet your lawmakers. It is important for our success.

Call USCIS and get your reciept number. Simple as that.
Some employers won't provide us the receipt notices for our I-485 applications. Yeah, it is supposed to be OUR application but that's how they play this game. Attorney refuses to release the RNs without employer's permission.
If we don't get our receipt notices, can we still change employer in 6 months using AC21. There must be a way out otherwise these suckers have an easy way to bypass AC21 laws...

Get enrolled in GNIIT course. They will teach you Java, .net, networking, datbase, algorithms and everything else that I did not put here and may be after that you can apply in EB-1 category. I am not mad but, if you do not have 4 year college degree, you should not have gone for EB-2 that too with labor substitution. It is a F***ed up system.

Now that the SEP VB is out, what does this indicate in terms of
- future VBs
- visa availability in the coming months
- awareness about visa wastage
- dates becoming current for most EB categories
- light at the end of tunnel for most of us

USCIS efficiencies :D : They are not efficient. People with PD in 2002,2003,2004 are still waiting and that are in 2006 getting released. Where is FIFO and efficiency in their process? No transparency in their process.

Does anyone have any insight on this thing called "Last Action Rule"?
Scenario:
1) Visa stamp till Feb 28,2007.
2) Extension of 3 year H1B based on approved I140 starting March 1,2007.
3) International travel, returning to the US on Feb 3.
Now at the port of entry, the officer takes an action of saying your I-94 is valid till Feb 27. Basically this invalidates your previous H approval that starts from March 1. Some "Last Action Rule".

I have question on comments from Kumar1
If 485 is denied does it mean your 140 approval is no longer valid?
I was always under the impression that I140 is a petition for immigration filed by the employer for the beneficiary while 485 is adjustment of status filed by the beneficiary on his/her own behalf.
If 140 approval does not remain valid then I agree with Kumar1 but if 140 remains valid then I guess the renewed H1B also should be valid as it is renewed on the basis of approved 140.
Can anyone throw some light on this?.... senior members..gurus..??

Unless you want a RFE get a new affidavit. It might take a day or 2 to get it from India but its worth it.

Jamaica does not require visa for Indian citizens, regardless of US status. One of the very few countries where Indians can go w/o visa along with Thailand and Hong Kong.

However, whether the fees are being used for overtime or for more people working on a case, that means USCIS is understaffed and needs to hire more people. In that case, isn't it logical that they would increase fees across the board for all applications, not just PP? i.e. fee hikes would be for new applications to pay for the extra resources, and existing applications should be processed under a flat fee for all cases.
If they are claiming that those who pay extra fees are entitled to faster processing, ahead of the line, then that, my friend, is a bribe, whatever official term is used. Because otherwise if they were understaffed, which it appears they are, they would simply raise fees for all applications.
I can understand a corporation doing this, like getting your tax refunds processed faster through a company if you pay more, but imagine if IRS suggested they would process faster for an extra fee.
They cannot raise fees without providing extra service. USCIS does raise fees once in while though. But the PP fees bring in a very large amount of revenue in comparison to small increases in regular fees.
Also, for better service, people often pay more. I invariably pay more in an airplane to be in the first class. Not sure why USCIS cannot use that logic to make some more money. I don't think it is comparable to a bribe. But, I guess we will agree to disagree here.

Are you out of your mind ? You are taking a huge risk by staying in the US and droping your Canadian PR because of some "probable" green card. What makes you think that by the time you finish school the situation will still be better in US. I hope you will not regret this but think about your family. In 3 years you and your family could be happily in BC with free health care, great weather, less stress, travel wherever and whenever you want, have your own law firm.
OR you could be a stressed H1B (a.k.a educated slave) waiting for I-140, I-485, EAD or whatever to come through.
Just because you asked, I have been in this same situation. But in my case, the decision was easy. I was on h1b making 69k. The same job in Toronto offer $55k CAD. Much less, but with my freedom to consult on the side and my wife's income we bring over $100k. We vacation in Florida for a month every year to visit friends. Life has never been better.
Whoever tells you to stay and take the risk is putting your family's hapiness in jeopardy. But the choice is yours. Just don't come here crying when CIS finds a problem with your application.

Yes! If there's nothing wrong in your EAD application (which should be none because USCIS received it), expect to receive your EAD approval on the third to last week of October.
NSC is already approving July 2 EAD applications as of the moment; therefore, your case is very near.
