The only major issue I see here is "Reasonable notice period"? what is considered to be sufficient notice period? If they say it is 2 weeks, then I dont see a problem in that. Most companies would expect that you provide them with atleast 2 weeks notice before leaving employment. This is normal. But without specifying anything of that sort, it is scary. After you sign the agreement, the company might come back and say, the sufficient notice period is 3 months, Then you are screwed. So, clear those things up.
As far as the accuracy is timesheets are concerned, those are pretty much standard language. Since you will get your timesheet signed by your client manager and always have a copy of this timesheet, you will be safe. Also, tranfering your billing is always part of any non-compete agreement. Not just with Desi consultants.
So, the only thing I see is the broader scope of the reasonable notice period. IF you can get that cleared and have the number of days of notice period expected in the agreement, you should be ok.

Thats correct. What I meant was, if you're planning to come back before 04/30 then are you planning to come back with the current visa or are you planning to get the new one stamped?
Also, you don't have a date gap in your visa in the passport. I-94 expires 04/2007 and have a new 797 from 05/2007. So I think you are good. I agree with you map_boiler. I have also seen from some other thread that some one with EB3/India/Apr 2004 PD got approval in July. If the July bulletin is void , How can they approve that ?
You are right , It looks like they approved cased with NO PD but with ready FBI check and also requested numbers for the current PD but sec check pending.
If a APR2004/EB3/India can get approval after Jul 2 , How can they reject EB3/INDIA/DEC2003 but filed on Jul2 ?
Returning numbers raise whole lot of questions. It remains to be seen how they try to untangle this mess.

I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

Ron gotcher makes sense to me. Considering the (quota + spill over) vs. the demand, it is just wishful thinking that all EB2-I with PD < 06/06 will get GC in the next few months. I also agree with others that in Oct EB2-I will retrogress back to the original levels (2004), it could go even beyond (to late 2002 or early 2003) that if a handful of EB2-I (who did not get a chance a last year) file 485 in the next 1-2 months.
2 yr EAD rule and this big EB2-I advancement could just be an unfortunate coincidence. But a lot of folks will sure find a 100% correlation nonetheless.

Reportedly, that is what the leaders of the agencies have been going through to abate things going out of control politically. Rep. Zoe Lofgren is a powerful chairwomea of the Judiciary Committee Immigration Subcommitee of the House of Representatives. Day before yesterday, she served a request for information, record, documents, and evidence in the tone of a discovery in the court proceeding. The letter resembled the combination of request for admission and demand for records in the federal court proceeding. The Secretary of Homeland Security was given only three days to meet the demand. Apparently, the leaders of the DHS and USCIS have been struggling to work out some kind of solutions and thereby prevent thing going out of control as the records, emails, documents, etc. etc. can turn out to be very smelly and juicy depending on which side of the party politics one is involved. Under the circumstances, the leaders have been talking about various options with the departments and pending the discussions, everything has been on hold including the visa bulletin release schedules.
Yesterday, we described potential four options for the DOS and the USCIS. Unconfirmed sources indicate that the last option appears to be "out." Obviously there are still under a tremendous pressure to work out a solution before the three-day deadline of the Congresswoman's investigatory demand. So yesterday (Saturday) was another surprize, a pleasant one again! I got a call from the same IO who told me that he got all the documents that I had sent and has cleared my case for approval, but now my fingerprints have expired.
He asked if I could come right away to his office and he could give me an instant fingerprinting appointment in the nearby INS office. When I told him that I'm currently out of country on business trip and won't be back in US till April, he said he will send me an appointment near April 15th.
I thanked him for his follow-up and he said he was just doing his job. I know this might be an exception than a rule, but just wanted to acknowledge this particular IO and hope there are more like him.
Did the IO made a international call (as you said you are out of country) to speak with you? If so how did he get your internation number.

Before Nebraska service center retrogressed their processing dates I was able to speak with an IO. I asked her a few questions relevant to this.
There maybe a public USCIS rule / procedures that would confirm what she told me.
Q) When is the name check typically initiated
A> Soon after receipt
Q> Is my name check cleared.
A> wait a moment..... yes
I've also explained why Nebraska processing dates moved back...
1) Transfers from Texas
2) VB moving forward coupled with no pre-adjudication. Therefore they have to go back to older receipt dates.
3) 180 day name check rule taking effect -- clean up old cases.
4) Public processing date was internally known to be too far ahead of reality (and therefore causing service requests).
Now could USCIS hide behind name check now?
Probably not for more than 180 days, because you could file a WOM and win.
Can they stagnate processing dates --- yes, and there is a risk that they will around 2nd July 2007 date (last year's fiasco -- if I need remind anyone). That would make me barking mad since my receipt date is about 59 days before that.
A WOM will likely succeed when an individual is arbitrarily processed more slowly, and now name check is not an excuse. However, a WOM is much less likely to succeed when a whole group is processed slowly, since USCIS can always claim resource constraints. The happened with labor cert and BECs, the case(s) that I read the judge basically said to speed up one application would slow down another. So you need to show that you are behind the reasonable processing times with respect to others, then you can force USCIS's hand.

My sympathies with your situation. If u can't go to India can't u use a service like mymaninindia.com to get you marriage certificate?
Also the best person to consult would be your lawyer as to whether u might get an extension to file your reply.

would decide thereby keeping the cost of IT infrastructure support for the
financial services, insurance, retail etc low just as mexicans work for
below min wages to keep the cost of maintaining the infrastructure low.

Basically, there are lot of people on the other site, who don't want to join IV but participate:) They think that they might be accidentally causing a benefit to IV by joining IV:)
This seems strange...no reason you cant be a part of more than one organization
and what kind of benefit as we talking about here?
are they also EB immigrants with the same Goal....do they have other different goals?
They want to come help with advocating...but do not want to benefit us...so they want to benefit us by helping out but they don't want to officially be seen as benefiting us?? lol seems like a weird funny paradox :D

I am a July 2007 I-485 filer and have my I-140 approved.
From what I read from the above thread -
1. Does it make sense to fill an I-9 form with the same employer and start working on EAD, instead of burning my remaining period in H1?
2. That way even if for some reason my I-485 gets rejected, I can continue working by switching to H1?

My i 140 is denied on A2P issues.Ive filed MTR.Any one knows how long it takes to hear back from them on MTR.anf if MTR gets denied can i file new 140 using same old labour ?some one help please >>>
I got my I140 approved just today!!. It was pending since Oct 2006. And then they denied it in March 2008. After filing MTR it took a month to get it approved.

I called USCIS and spoke to Nebraska IO and she said they are sorry some of these notices went out in error. She checked my case and said I am set and no need to panic.
