infopass apt couple of weeks back..IO told me NC pending, case with officer (whatever that means :().

sometime's if they need to do some background-investigation to get more info on your visa status / educational background / name check or what-ever for no-reason etc , they just place you in this status. the tricky thing is do never know how long the wait is. ive heard / read some people have to wait in months for no reason. you should be happy that you received it in 2 weeks.

Actually CIR was started by President Bush to regain hs popularity. Other than that it is complicated and tough to pass thru. Really lawmakers have to work hard f they want to pass because it is tough to satisfy all. So most of them must be cautious unless it comes up for discusson. Moderate people may try to maintain status quo. If CIR is pendng then all the immigration related items including EB relief will be attached to it(People will try to attach so that it can be delayed as much possible). If Congress starts discussion on Jan 2007 possiblity of becoming law is on May if they introduce CIR. But immigration may not be that much national importance issue for US congress. It does not matter whether an illegal immigrant will become citzen on now or 2009. Economy will not have an impact. Similarly a H1 person gets gc now or 2009 or 2011 the impact will be mnimal for US but impact will be heavy for that immigrant. Also Economy may slow down n 2007 and job demand may go down then it is tough to justify increase of H1 when joblessness starts increase.
I think EB2 will improve much better in coming months and EB3 also PD will move at least a few weeks to few months. Atleast people could extend H1 after 6 years. In 1999 and 2000 people did not have that option and some people left USA and came back after year. So to get gc was challenging atleast for 50% of people for past 10 years. Some people got this easily some time in past.

If someone has EB2 application, and EB2 is unavailable, but their EB2 PD is current with respect to EB3 visa bulletin date, will USCIS allow an EB2 to take an EB3 slot?
If not I wonder whether you can "down grade" by interfiling a new I140.

If they ask for police clearance .. you give it..
Unless it was a felony that requires certain jail-time or something it's not always counted against you.. remember .. purpose is not to exclude shop-lifters.. they got plenty of those in Canada but rather identify and filter out security hazards.. you might need in person interview.. but it should be alright.. I know even US immigration allows folks like that.. so can't imagine Canada being more stringent..

There is a little chance if you had 3+2 years degree and the labor was looking for Bachelor’s and would accept equalent foreign degree as evaluated by reputed firm. I believe your diploma was the hurdle.

I have created several documents and am working on a similar one as outlined below. But we need 50 people working on such items instead of one.
We have lots of ideas pouring into threads here but most are soon forgotten and not followed up on.
gc_peshwa has created a googlegroup to deal with participating on USCIS calls etc. We can add this agenda to that group to prevent creation of too many googlegroups and spreading ourselves thin. Alternatively we have a "Media" googlegroup as well which is dormant. That group could be used for this purpose.
This is interesting..i am down to help if you are looking for volunteers....I completely agree that lawmakers often overlook the advantages of temporary legal immigrants and by publishing suck documents will certainly help

The current economic crisis has many victims. To hear about this 90 year old woman who attempted suicide is depressing too. There is a slight twist at the end, Fannie Mae forgave her debt.

On a different note, what about us folks who have been on this never ending path to legal immigration for ever and such events e.g economic crisis, rising unemployement etc impact us in a huge way and we don't have any recourse. What do you guys think should the USCIS do? Should they "forgive" us our circumstances. Should there be special rules in these unforseen circumstances?

If one gets a US Masters, the 3 year undergrad is not a problem if you go for EB2 based on Masters.
You cannot get a masters from a good universitiy based on 3 year undergrad from India. However, there are many shady universities in the US that will give away masters degree for some money. Most of the people in IT use these routes and the USCIS is coming hard on them. univ of Pheonix, even though an accredited univ, is an invitiation for greencard audit. You can try your luck. Chances are slim. Make sure you don't screw up your eb3 application.

I wouldn't care to much if they steamline the process and make all EB categories "Current". If you submit the right documentation these days i-140 does not take more than an month.
But if the retrogression is like this then as well a retrogressed person does not care as in any case he cannot file together. The only people who are affected is the people who are eligible to apply for both with the PD as current. But how many people are there now in that frame of benefit.
So I really feel it should not bother us too much especially people from India. If I am wrong correct me.

AFAIK, those who become ligible to receive stimulus in 2008 can claim stimulus of previous year. IRS will post information - how to claim it.
UPDATE: Refer to (Thanks gc_dedo) irs has already posted ...
There is no fresh memo for becoming ligible, it still holds that both filing jointly should have SSN. If one was not having SSN (in 2007) and could not get last year (in 2008) still won't get stimulus - unless ligibility is changed by IRS and ITIN is brought into it.
I am not sure how much this mechanism works - file alone to get stimulus and then modify return by filing jointly. People who have done this (with 2007 return) should post their experience of returns of 2008 - whether IRS allowed it or not.

Our strategic Counsel, Quinn Gillespie & Associates (QGA) has begun setting up meetings for us with lawmakers and congressional staff in a big way.
Three of our volunteers are in Washington DC this week. Yesterday, we met with Chief Counsel of the House Sub Committee on Immigration and also California Congresswoman Zoe Logfren's Senior Aide and get the House view on Comprehensive Immigration Bill. We were also interviewed by Kate Ackley, Reporter for Roll Call (http://www.rollcall.com/). Roll Call is THE newspaper read by lawmakers and their staff and the best way for us to get the message to them.
Today they have already been to White House and spoken to senior people to get the Administration's view on immigration. They have 2 more meeting for the day.
They have another full day on Friday and Monday also, when they will be meeting with 3-4 Senator's staff on each day. All these senator's are high powered senators who will be able to very much further our cause.
More details of these meeting will follow shortly, when they are able to get a breather from all those meetings.
To maintain this kind of excellent service provided by QGA, we urge our members to please contribute monetarily to IV.

The USCIS has not taken any official position on whether they would allow the after I-140 3-year extension to be transferred to another employer.
Using this loophole looks like many of us have actually sucessfully tranferred the H1B to a new employer after the 6 year limit..
As long as USCIS does not release any regulations...We can do this ....
If asked officialy some attorneys say that it cannot be done and some are fine with that...
Immigration laws are kind of applied sporadically and can be pushed to a certain extent
