For the pessimists among us who doubt the utility of what we can achieve, I have compiled the following FAQs:
1/ Isnt it very unlikely that a senator or congressman will listen to us or care about our agenda?
It is extremely likely -almost guaranteed- that US lawmakers will listen to us and incorporate our amendments, as long as they are reasonable, fair and not inimical to US interests (which our suggestions most certainly fit with). The system here works very differently than what several of us may be used to in our own home countries, where it might be near impossible to get things through to lawmakers without �connections�. Several of those here who witnessed the S1932 campaign in December were surprised at how easily accessible the lawmakers and their staff were, and how receptive they were to our requests and suggestions. We have to make sure that we present our arguments intelligently, and show them how closely they are linked to long term US interests.

It is good idea. I discussed this my lawyer and according to him, nowadays USCIS is very strict about it and trying to match the requirements of EB2 against the candidate's credentials. If it perfectly matches only they will approve. It will be an option for those guys with EB3 with PD past 2005 and with enough EB2 credentials, primarily a masters degree and if it from US, then great.
Please do not go into this option just by stating that I have 100 years experience with such and such company. I will say, if your are a masters degree holder (from US the best) and is employed with a major employer for more than 3-5 years, then only attempt this. Do not try it if you are employed with some Desi company. This is harm both the candidate and the employer.

Please do not quote from memory, if this has happened in specific cases,mention the details with the OES/SOC Code. In most cases, EB2-Job requirement: Bachelors+5 years.
Any EB3 pre 2008(post 485) should be able to use it.Please check with your attorneys and not 2 cents. And, especially, scared guys like the above, saying that it will harm you to go to EB2.
If you are pending 485, even if ur new I-140 gets revoked, does it matter if you have the older I-140.

The only requirement is that both I-140 must have same beneficiary and all I-140 must belong to eb-1, eb-2, OR eb-3 preference categories.

First of all, ethnicity has nothing to do with hard cap.
Today, the soft cap exists, and the numbers are retrogressed only for India and China. REST of the world is current. Hard cap would make things worse for only those countries that have higher demand and WASTE the visa numbers.

please be more accurate. Rest of the world in EB1 and 2 are the only categories that are current ..
Rest of the world EB3 folks are heavily retrogressed to 2001 as everyone else..

It is interesting......why does congressman/senatorial inquiry works for some and not for some. What can we do differently. I sent out a "Thanks...but no thanks" email back to Congressman's office.
I mentioned that I expected that a congressman's inquiry will at least make TSC to look into the case and do a due diligence but not throw the same reply that they'd to individual inquiry.

my application reached NSC at 7:55am on July 2nd and I got my physical receipt notice today, mine was signed for by R Williams. checks didnt get cashed yet.

It makes no difference whether they allow concurrent filing of 140/485 or not That's not always true. Without concurrent filing my son will not be able to file 485 because he will turn 21 at that time. And I'm pretty sure there are other cases when concurrent filing was very helpful.

With the new rule on FBI name checks, a potential 47K with current PDs could get their GS's soon. I wonder how much of a shift we will see in the PD's from now, after the 47K is not taken into account. I would predict a minimum of atleast a year jump, or am I being optimistic. :confused:

Just a note, applications were accepted till 17 August, 2007.
This thread is started to just gather the list of people who have approved Labor as on 31st Jul,2007 and could not file I-485 for various reasons like out of country,Not married, Employer did not file or Lawyer delayed etc.

Looks like it is the photos. I got the RFE after opening a Service Request and they have asked for photos. Morons. They could have made it clear in the instructions to send photos.
It doesn't happen to everyone. A couple of my friends got the ead without sending the photos. It all depends on who processes your application. If he is an ass, you are in trouble.
So, better send the pictures if you are planning to e-file.
I have sent the photos and now have to wait for another 45 days. Hopefully a smart guy who knows what he is doing will process it this time.

Hi,
My company is asking me to pay the extension fees for 3rd term with same company. I had approved 140. In USCIS receipt it says amount received: $320. Then why I am asked to pay $1820. Is the $1500 towards training is to be paid by employee or employer?
Most probably the 1500 is attorney fees.

It does not charge some of the fees - like the appraisal fees, etc + reasonable, competitive rates. They also guarantee to get all of the closing done within a certain period of time, which they usually beat by at least a couple of days! We have our mortgage with them presently. There is also Sallie Mae Home Loans (http://https://www.smhl.com/index.html)! We had our first home loan with them, but then they sold it to AmTrust Bank (http://https://www.amtrust.com/Personal/Pages/home.aspx) formerly known as Ohio Savings Bank. Our rates or anything else did not change. We live in AZ.
You should window-shop around as much as you can, but remember to initiate all of your inquiries within a 2-week period - so it is counted as a single hit on your credit history!
Discussing all aspects of mortgage - there is an excellent resource, The Mortgage Professor (http://http://www.mtgprofessor.com/) ! As immigrants, we have to share all info we can, the kind of info that is usually shared between family/ friends if you stay where you were born!
