There are 2 things that you need to do and take time..
1. Apply for FBI fingerprint clearance .. You can take fingerprints in your local sheriff's office on a standard FBI form and then send it to FBI.. takes about 2 months.
2. Apply and get IELTS english score.. I think this has become standard now..
I had attached all the literatures that had been published on Finance and technical journals. In addition, I had US education with Masters. Still, they asked me to appear for IELTS.
If you native language is not English, IELTS is must.

The pattern of RFE's on AP's are from those cases applied at NSC >> CSC issued Receipts/EAD/AP >> 485 back to NSC.
I got an RFE for I-131 for both myself and my wife. They have asked for absolutely everything (I-485 receipt, I-140 approval, I-94s, I-797s, marriage certificate, Passport copies etc). As my lawyer said "they have thrown the kitchen sink at you".
I dont even know why - but the amount of documentation they have asked for seems absurd just to issue a travel document.
BTW - my EAD from the sample application was approved!

I do have a D70 as well as other AF and non-AF cameras and never had such problems before. I have backfocus-problems with all lenses on the D70. I ran some simple testing that confirmed this. In practice, this will only be a problem shoting faces wide open - but here, it's quite bad.

Can you pick an year and month for EB2-India for the October 2008 Visa Bulletin (start of new fiscal year)?
Ron Gotcher believes EB2-India will be somewhere at 2002/2003.
Even the prediction of end of the universe could be made more accurately than what will happen to the visa bulletin. It's true there may be retrogression in Sep 08 for EB2-I, but the movements back and forth are likely to be minimal.

I was wondering how L1 can be allowed instate tuition while H1-B's have to pay out of state according to the Arizona list. What exactly is the fundamental difference between the 2 which results in L1's fulfilling the requirements?
GCard Dream - You should ask the question - what part of the statute does L1 fulfil that H1B does not -
I'm sure you can give these guy's a run for their money. One thing - if you pursue it long and hard enough I think there is a chance that you can get instate tuition. The only area I was concerned about was the domicile part but if L1's can prove domicile so can H1-B's.
My son was able to get in-state tuition at Arizona State University after we filed an appeal. The new rule allows those who have filed I-485 to get in-state tuition.

I have a medical RFE. RFE asks me to go back to the original Civil Surgeon. Since I have moved to different place going to same civil surgeon is not an option.
Has any one run into similar situation. If so please share your experience.
Maybe the IO is asking you to go to the original civil surgeon so they can make a correction/addition to the original.
I would advise you to get the whole medical redone from a new doctor(close to your home). This way IO doesnot have to compare the original and the additional results as per the RFE.
I went to a different civil surgeon as i had moved to a different state. Some doctors have a standard fee for immigration medical. Best would be for you to get the whole medical redone and submit. Take a copy of your previous medical so they can copy your immunization records. This way you can avoid some vaccinations:)

I think ppl who have masters or above from accredited US university shouldn't have any visa restriction; meaning they shouldn't be counted towards their country quota. No cap for Masters from US University -:)

My 8th year H1/H4 extension applied @VSC on 10/22/2007. My employer received approval letters on 01/31/2008. As of today my online status still shows as "Case received and pending" (now that's why I call USCIS is a useless system):D
Note: on 01/24 & 01/25 there were LUD's on both H1/H4 cases and nothing changed with online case status
EB2-140 @ TSC still pending.

Those giving the interview please make sure that the point that you put across is that though you lost job . could get another one but couldn't take it up/apprehensive about taking it up because of the AC21 uncertainty/GC uncertainty.

If not careful about what should be highlighted and put across in the interview there is a chance of people picking up just three words "immigrants" "jobloss" "foreclosure" and start making unfair/unnecessary accusations like:
' Immigrants are contributing to foreclosures/housing crisis
What are the immigrants that lost jobs doing here when many of the citizens are losing jobs and are not able to find new jobs'

Thank u so much for the info you've collected. In my case, PP expiry is sometime in August. So no issues with that. And I assume the I-94 date issue is applicable only if I used the AP instead of AVR while coming back.
And yes, as per Murthy's site, I'd be carrying the telegram with me to show the IO if needed. And yes...you are right. Its only good NOT to lie to the IO at the POE and promptly tell him that I had been to Canada for landing purpose. After analysing the situation on that link, I think its wise NOT to LAND in Canada for a PR status while 485 is pending although some people can get lucky if the IO doesn't notice. But in the worst case scenario, an RFE on 485 is definitely not a good sign even if there could be ways to get thru it by replying back with reason etc...Bottom line, the 485 adjudication can take a while and might even get rejected with this RFE what with all the stringent laws and scrutinization.

It certainly seems like the RFE rate for supportive evidence has increased recently. Certainly for the 140 cases but also for other petitions as well. I had never received an RFE before, but recently got 2 for different petitions. An RFE always makes you a little antsy no matter how routine it is.
We are also hearing about PERM audits higher and denials also more frequently.
So far the RFEs seem to be for the common issues, like ability to pay, education qualifications etc.
It might be a good idea for someone to compile a list of typical RFEs at various stages. The rest of us can start adding for the benefit of those who get one in the future. In fact it might have been done already. I remember Logiclife putting something together during that 485 filing time in July/Aug.
